Booking Terms & Conditions

Please read the following as it contains important and binding information in relation to our client dealings.

General

1. Y Travel incorporating Trans World Travel refers to the company Y Travel Pty Ltd.  A.C.N 005514376 to be referred to as “Y Travel”.

2. “Client” refers to the person making the enquiry/booking/reservation as well as all travellers included in the booking/reservation.

3. “Suppliers” refer to all service providers engaged by Y Travel

4. By making an enquiry or booking request the client acknowledges that they have read, understood & agree to be bound by these Booking Terms & Conditions.

5. It is strongly recommended that the Client checks advice provided by the Australian Department of Foreign Affairs for the most up to date travel documentation requirements for each county the Client intends to visit (refer https://www.dfat.gov.au/  or call 1300555135). For Clients with non-Australian passports please consult your home country's Department of Foreign Affairs or equivalent government agency for travel documentation requirements.

 Bookings

1.  Reservations are subject to availability & will only be converted to a booking subject to confirmation from the Client & acknowledgment from Y Travel. Prices are only guaranteed once the booking has been confirmed & required payments made.

2.  Airfares are subject to change until tickets are issued & payment made in full.

3. Instructions for the payment of deposits & all other required payments will be advised by
Y Travel. Failure to comply with these instructions may result in the booking not being confirmed & prices increasing.

4.  All fees payable are as per Y Travel’s Professional Fee Schedule. Any variation to the schedule will be solely at the discretion of the Directors of Y Travel. The Professional Fee Schedule forms part of these Terms and Conditions.

5. All quotes are in Australian dollars unless otherwise advised. If quotes are in any currency other than Australian dollars, then the quoted amount in the foreign currency will affect the Clients’ final costing as a result of currency fluctuation. Y Travel cannot be liable for any currency fluctuation.  As per item 3 above the booking cost is not finalised until the required payment has been made.

6. It is the Client’s responsibility to provide exact correct name details per the Clients passport to Y Travel. An incorrect name may result in a Client being denied boarding onto a flight or the need to reissue a ticket. All costs associated with rectification are to be borne by the Client.

7. If a Client has a booking of any sort including but not limited to flights, accommodation or tours and fails to show up on time or at all (no show) Y Travel are not responsible, and you will not be entitled to a refund or credit from the Supplier.

8. Additional fees incurred by Clients whilst traveling including but not limited to resort fees, room charges, dining costs, tours or taxes are to be borne by the Client and paid directly to the Supplier.

9. Merchant charges are in addition to any booking costs, unless the Supplier accepts direct credit card payment. 

Health

1. It is the Client’s sole responsibility to ensure that they are in the correct physical and mental condition to undertake any travel booking requested to be made by Y Travel. Y Travel will not accept any liability whatsoever if a booking is required to be amended, changed, cancelled as a result of a Client being unable to complete a trip. Any changes required may be subject to Suppliers fees and will be subject to fees per Y Travel’s Professional Fee Schedule.

2. It is the Client’s responsibility to disclose any special requirements they have such as but not limited to medical or dietary needs. Y Travel cannot be held responsible in any way as a result of the non-disclosure of special requirements. Any additional costs incurred as a result of any amendments made due to special requirements are to be borne by the Client. It is the Clients responsibility to advise Y Travel if they are pregnant as this may affect booked activities including but not limited to flights. Y Travel cannot be held responsible if a pregnant Client is refused access to any activity or flight if disclosure has not been made.

3. It is the Client’s responsibility to seek their own medical advice in relation to required vaccinations for each location they intend to visit. Y Travel are not responsible in any way if a Client does not receive correct vaccinations. Any costs incurred by the Client as a result of non or incorrect vaccination is the responsibility of the Client and cannot be charged to Y Travel. 

Amendments & Cancellations

1. If a request is made to cancel a booking all attempts will be made to secure a refund of payments made or a credit towards a future trip, but no guarantees can be provided. Cancellation policies may vary between suppliers. Please also refer to the Y Travel fee Schedule fees which are in addition to any Supplier fees.

2. Once a booking has been confirmed any changes requested will be subject to availability & Y Travel cannot guarantee availability or that pricing will be the same. Such changes may incur fees from both the Supplier and or Y Travel.

3. Any additional costs incurred as a result of any amendment whatsoever charged by but not limited to an operator, hotel, airline, cruise company, car rental company or any other Supplier is the sole responsibility of the Client & will be paid for by the Client.

4. Any refund in a foreign currency will be affected by currency fluctuation & banking exchange costs. Y Travel cannot be liable for any differences between payments made & refunds received.

Insurance

1. It is the Client’s responsibility to ensure that they are adequately insured. Y Travel strongly recommend Clients have comprehensive travel insurance. Y Travel can recommend insurance if requested by the Client. It is the Clients’ responsibility to ensure insurance covers all activities such as but not limited to adventure, trekking, skiing, scuba diving.

2. Y Travel cannot be held liable for any cost as a result of Clients not having adequate travel insurance.

3. Insurance should be taken out at the time of booking to cover any unforeseen circumstances prior to departure resulting in changes/cancellation of a trip.

4. Insurance should cover but not be limited to cancellation fees, loss of deposit, balance payment, damage to or loss of baggage or money, medical & hospitalisation costs, repatriation, or curtailment expenses as a result of sickness, injury or pre-existing medical condition.

Suppliers

1. The Client acknowledges that Suppliers are independent suppliers/contractors and are not under the control of Y Travel. Suppliers’ terms and conditions must be complied with by the client. A copy of Suppliers Terms and Conditions will be provided.

2. Y Travel will do all possible to match the Client’s needs with the appropriate Supplier. The Client agrees that the final decision has been made by the Client.

3. Y Travel cannot be held responsible for the performance of any Supplier in any way. The Client releases Y Travel from any liability for loss, damage or costs as a result of any act or omission of a supplier or the Supplier failing to meet the Clients’ expectations.

4. Clients with any complaints whilst travelling must notify the Supplier/ground operator & Y Travel immediately preferably in writing. Y Travel will do all possible to assist with a remedy, but Y Travel cannot be held responsible for any occurrence leading to a complaint.

5. The Client acknowledges that Y Travel deal with Suppliers on behalf of the Client. It is general practice that a fee or commission be paid to Y Travel by Suppliers & that the commission can be retained by Y Travel at its own discretion without the need to account to the Client.

Force Majeure

1.       A Force Majeure event refers to any circumstance beyond the reasonable control of Y Travel. It may include without limitations acts of God, flood, fire war or threat of war, sabotage, terrorism, piracy, civil disturbance, sickness, epidemic or pandemic, quarantine, government intervention, weather conditions, alteration or cancellation of scheduled or other air service.

2.      Y Travel will not be in breach of any booking conditions including but not limited to cancellation or changes as a result a of Force Majeure.

3.      Y Travel will do all possible to assist the Client in the event of any required changes resulting from a Force Majeure. Any additional costs will be borne by the Client. Any fees charged by Y Travel will be in accordance with the Professional Fee Schedule.
